Pixter Learning LLC ("Company," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the GabaBrain application and website (collectively, the "Service").

Please read this Privacy Policy carefully. By using the Service, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Service.

1. INFORMATION WE COLLECT

1.1 Information You Provide

We collect information you provide directly to us, including:

Account Information: Name, email address, username, password, profile picture, and avatar customization choices.
Profile Information: School, instructor preferences, courses, and study preferences.
User Content: Flashcards, quizzes, study materials, and other content you create or upload.
Communications: Messages, feedback, and correspondence with us or other users.
Payment Information: Billing address and payment method details (processed securely by third-party payment processors; we do not store full credit card numbers).
Survey Responses: Information you provide in response to surveys or promotions.

1.2 Information Collected Automatically

When you use the Service, we automatically collect certain information, including:

Device Information: Device type, operating system, unique device identifiers, browser type, and mobile network information.

3.1 With Other Users

Your username, avatar, and public profile information are visible to other users.
Study materials you create may be shared with other users based on your privacy settings.
Leaderboard rankings and achievement information may be visible to other users.
When you participate in multiplayer challenges, your username and scores are visible to other participants.

3.2 With Service Providers

We share information with third-party vendors and service providers who perform services on our behalf, such as:

Cloud hosting and data storage providers
Payment processing companies
Analytics providers
Customer support services
Email delivery services

3.3 For Legal Reasons

3.6 FERPA

If Pixter Learning LLC enters into agreements with educational institutions, additional data protection terms may apply, including restrictions on use and disclosure of student education records in accordance with the Family Educational Rights and Privacy Act (FERPA).

3.7 Text-to-Speech

GabaBrain includes an optional read-aloud feature. When you press the speaker button on a question, we send that question’s text and its answer options to Google Cloud Text-to-Speech, operated by Google LLC, which returns spoken audio. This happens only when you press the button. We do not send your name, email address, account identifier, avatar, study history, scores, or any other information about you along with that text — Google receives the question text and nothing that identifies who asked for it. Google states that it does not log the text or the audio involved in these requests. We store the returned audio on our own servers so that the next person to play the same question is served the saved audio and the text is not sent again.

If you create your own study material and use the read-aloud feature on it, the text of those questions and answer options is sent to Google in the same way and under the same terms described above. If you would rather your own material never leave our servers, do not use the read-aloud feature on it.

4. COOKIES AND TRACKING TECHNOLOGIES

We use cookies and similar tracking technologies to collect and track information and to improve the Service. Cookies are small data files stored on your device.

4.1 Types of Cookies We Use

Essential Cookies: Required for the Service to function properly.
Analytics Cookies: Help us understand how users interact with the Service.
Preference Cookies: Remember your settings and preferences.
Advertising Cookies: Used to deliver relevant advertisements (in the free tier).

If you use the free tier of the Service, we may use advertising or analytics partners that collect information for targeted or cross-context behavioral advertising. 7. CHILDREN'S PRIVACY

The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at support@gababrain.com.

If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information as quickly as possible.

For users between 13 and 18 years old, we encourage parents and guardians to monitor their children's online activities and to help enforce this Privacy Policy.

8. YOUR RIGHTS AND CHOICES

8.1 Account Information

You may update, correct, or delete your account information at any time by accessing your account settings. If you wish to delete your account entirely, you may do so through the app settings or by contacting us.

8.2 Communications

You may opt out of receiving promotional emails by following the unsubscribe instructions in those emails. Even if you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

8.3 Push Notifications

You can disable push notifications through your device settings.

9. U.S. STATE PRIVACY RIGHTS

9.1 Your Rights

Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions.

Pixter Learning LLC does not sell your personal information to third parties for monetary value.

However, if you use the Free Tier of the Service, we work with third-party advertising partners who may use cookies and similar technologies to collect identifiers and internet network activity to serve you relevant advertisements. Under certain state laws (including the California Consumer Privacy Act as amended by the CPRA), this activity constitutes "sharing" of personal information for cross-context behavioral advertising.

9.3 How to Exercise Your Rights

To exercise your rights, including the right to opt out of "sharing" or targeted advertising:

10. INTERNATIONAL USERS

The Service is operated in the United States. If you are located outside the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Service, you consent to the transfer of your information to the United States.

11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Service and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.
