1. OUR COMMITMENT TO COPYRIGHT

Pixter Learning LLC ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. GabaBrain complies with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright laws.

We respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. As part of our response, we may remove or disable access to material claimed to be infringing and/or terminate the accounts of users who are repeat infringers.

2. HOW TO FILE A DMCA TAKEDOWN NOTICE

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Service, please send a written notification to our designated Copyright Agent with the following information (as required by 17 U.S.C. § 512(c)(3)):

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the specific URL(s) where the allegedly infringing material is located.
Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

IMPORTANT: The DMCA requires that you make your complaint under penalty of perjury. Misrepresentation of material as infringing may result in liability for damages, including costs and attorneys' fees. If you are not certain that material infringes your copyright, you should consider seeking legal advice before submitting a notice.

4. PROCESSING OF NOTICES

Upon receipt of a valid DMCA takedown notice, we will:

Promptly remove or disable access to the allegedly infringing material.
Notify the user who posted the material that it has been removed or disabled.
Provide the user with a copy of the takedown notice (with your personal contact information redacted if you request).
Inform the user of their right to submit a counter-notification.

5. COUNTER-NOTIFICATION PROCESS

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. Your counter-notification must include:

Your physical or electronic signature.
Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the judicial district in which Pixter Learning LLC is located if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will:

Promptly provide the original complainant with a copy of the counter-notification.
Inform the complainant that we will replace the removed material or cease disabling access to it within 10-14 business days.
Replace the removed material or restore access within 10-14 business days, unless the complainant notifies us that they have filed a court action to restrain the alleged infringement.

6. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

A "repeat infringer" is a user who:

Has been the subject of more than two (2) valid DMCA takedown notices; OR
Has had User Content removed from the Service more than two (2) times for copyright infringement.

We may, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

If your account is terminated under our repeat infringer policy, you are not entitled to any refund of subscription fees or point purchases.

7. MISREPRESENTATION WARNING

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Before submitting a DMCA takedown notice or counter-notification, please carefully consider whether the material at issue actually infringes your copyright or was removed by mistake. You may wish to consult with an attorney if you are unsure.
