Copyright & DMCA Policy

1. Our Commitment to Copyright

Pixter Learning LLC respects the intellectual property rights of others and expects our users to do the same. GabaBrain complies with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright laws.

We respond to notices of alleged copyright infringement that comply with the DMCA. As part of our response, we may remove or disable access to material claimed to be infringing and/or terminate the accounts of users who are repeat infringers.

2. How to File a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Service, please send a written notification to our designated Copyright Agent with the following information (as required by 17 U.S.C. § 512(c)(3)):

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing and information sufficient to locate the material (specific URLs).
Your contact information (address, telephone number, and email).
A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
A statement that the information is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Designated Copyright Agent

IMPORTANT: The DMCA requires that you make your complaint under penalty of perjury. Misrepresentation may result in liability for damages, including costs and attorneys' fees.

4. Processing of Notices

Upon receipt of a valid DMCA takedown notice, we will:

Promptly remove or disable access to the allegedly infringing material
Notify the user who posted the material that it has been removed
Provide the user with a copy of the takedown notice
Inform the user of their right to submit a counter-notification

5. Counter-Notification Process

If you believe that material you posted was removed by mistake, you may submit a counter-notification to our Copyright Agent. Your counter-notification must include:

Your physical or electronic signature
Identification of the material removed and its former location
A statement under penalty of perjury that you believe the material was removed by mistake
Your name, address, and telephone number
A statement that you consent to jurisdiction of the Federal District Court and will accept service of process

Upon receipt of a valid counter-notification, we will provide the original complainant with a copy and restore the material within 10-14 business days unless the complainant files a court action.

6. Repeat Infringer Policy

We have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. A "repeat infringer" is a user who has been the subject of more than two valid DMCA takedown notices or has had content removed more than two times.

If your account is terminated under our repeat infringer policy, you are not entitled to any refund.

7. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. If you are not certain that material infringes your copyright, consider seeking legal advice before submitting a notice.
